John Warren focuses his practice on construction, real estate and development related matters and disputes, including design defect/delay claims, mechanic's and materialman's lien claims, performance and payment bond claims, breach of contract and negligence claims, prompt payment claims, foreclosure and deficiency actions, lender liability issues and lease/title/real property disputes. John has been involved in cases involving convention centers, schools, hospitals, office buildings, condominiums, commercial/retail buildings, strip malls, airports, roads, oil and gas pipelines, raw land and residential construction. In addition to his litigation practice, John also regularly drafts and negotiates construction contracts.
Prior to his career as an attorney, John earned a Bachelor of Science degree in Architectural Engineering from the University of Texas at Austin and worked as a Project Manager for a high-end general contractor. As a Project Manager, John acted as the liaison between owners, architects, engineers and subcontractors on a variety of different construction projects, gaining valuable experience and insight into the construction industry.
REPRESENTATIVE EXPERIENCE
- Obtained summary judgment and recovered defense costs on behalf of a concrete subcontractor against owner in a multi-party construction defect arbitration with alleged damages of over $25 million related to foundation issues on a school project.
- Obtained summary judgment on behalf of lender for damages of over $2.2 million related to a residential development project, simultaneously disposing of all claims brought by borrower with alleged damages of over $1.6 million.
- Obtained multi-million dollar settlement on behalf of general contractor against governmental entity and architect in breach of contract case related to design deficiencies on a convention center project.
- Obtained summary judgment and defense costs on behalf of general contractor in district court case involving breach of contract and fraud claims brought by subcontractor related to a commercial build-out project.
- Obtained arbitration award on behalf of custom home builder for over $500,000 in construction defect case against subcontractors related to residential project.
- Obtained summary judgment on behalf of lumber supplier in defense of trespass and conversion claims brought by land owner.
- Represented general contractor in construction defect and delay case with alleged damages of over $28 million involving a 10-story bank building.
