David Gregorcyk handles the prosecution and defense of a wide range of commercial disputes in litigation before state and federal courts and alternative dispute resolution forums on behalf of clients throughout South and Central Texas. David's practice is focused primarily on the representation of commercial general contractors and subcontractors in construction-related disputes. He develops and maintains comprehensive litigation strategies designed to achieve successful results in the most efficient manner possible. 

David was named a "Rising Star" by San Antonio Scene magazine in 2011 and 2012. In addition, he has authored articles for local trade journals on legal issues facing the construction industry and is fluent in Spanish. 

 

REPRESENTATIVE EXPERIENCE

  • Represented a commercial general contractor in a complex, multi-party construction defect claim involving more than $15 million in alleged damage to an apartment complex. 
  • Obtained $300,000 award of attorneys' fees on behalf of insurer in connection with declaratory judgement action in federal court; successfully defended appeal of award before U.S. Court of Appeals for the Fifth Circuit. 
  • Defended commercial concrete contractor and surety against $2 million claim by precast subcontractor to recover damages for delay, acceleration, and labor productivity and multiple other claims by subcontractor's suppliers. 
  • Represented design/build contractor in dispute regarding collapse of a parking garage.
  • Obtained favorable settlement on behalf of major insurance carrier in lawsuit filed by policyholder seeking more than $20 million for Hurricane Ike-related damage to three multifamily properties. 
  • Defended residential contractor in lawsuit filed by developer to recover more than $800,000 in liquidated damages for contractor's wrongful termination of master development agreement.
  • Obtained favorable settlement on behalf of corporation and its president in derivative action filed by shareholder alleging breach of fiduciary duty and minority shareholder oppression. 
  • Represented commercial general contractor in arbitration with roofing subcontractor; all claims asserted by subcontractor were denied and general contractor was awarded more than $300,000 on counterclaims. 
  • Obtained injunction on behalf of commercial general contractor against a large school district for violation of competitive bidding procedures under Texas Government Code.
