Seth Rubinson has successfully litigated hundreds of complex, high-stakes cases with a particular emphasis on the representation of general contractors, owners and developers in construction matters. He has served as regional and national counsel for several manufacturers, and has handled the coordination and management of multi-jurisdictional litigation. Seth also represents businesses and individuals in commercial disputes, professional and general liability, and first and third-party insurance matters.
Seth regularly provides business counseling and preventive litigation strategies to businesses and individuals, including the construction, medical, non-profit and accounting sectors. He is instrumental in helping his clients prevent disputes by minimizing potential liabilities and developing proactive plans for risk management.
Seth is admitted to practice law in Texas, Florida and Massachusetts. His practice in Florida, particularly the representation of owners, developers and general contractors in matters of construction law, remains very active and Seth is available to our clients for consultation regarding matters of Florida law.
Seth is AV Preeminent rated by Martindale Hubbell peer review ratings, the highest achievable, and was selected as a 2011 Rising Star by Florida Super Lawyers and a 2012 Rising Star by Texas Super Lawyers, a recognition awarded to only 2.5% of the Florida and Texas Bars.
REPRESENTATIVE EXPERIENCE
- Obtained a $5 million verdict for national natural gas transportation company against contractor for breach of contract and defeated contractor's counterclaims alleging that pipe provided by company was defective.
- Represented top ten national contractor in highly complex construction licensing issues case, resulting in the overturning of an adverse summary judgment ruling and preservation of claims valued over $25 million.
- Represented leading national LNG tank construction company in arbitration relating to over $20 million in claims, successfully defeating summary judgment efforts and preserving claims for exemplary damages and attorneys' fees.
- Obtained summary judgment disposing of $15 million performance bond claim based on obligee's denial of surety cure rights after contractor's predecessor counsel filed motion on different grounds, resulting in denial of summary judgment and substantial exposure.
- Successfully settled highly complex construction dispute relating to prominent mixed-use retail and residential construction project at a small fraction of full value, terminating potential $50 million exposure to one of the nation's largest general contractors.
- Obtained summary judgment for prominent group of emergency physicians sued in qui tam whistleblower action.
- Acted as national counsel for one of the world's largest web offset printing press manufacturers in all products liability litigation within the United States.
- Represents a range of national companies in various business sectors to develop preventive litigation strategies to minimize risk and maximize profitability. Services include contract review and development of policies and procedures.
- Represented numerous businesses at trial before licensing commissions for alcoholic beverages, preserving licensure and business profitability.
