Misty Segura has substantial experience representing clients in a wide variety of commercial and bankruptcy litigation matters and now focuses her practice in these areas. She has first chair bench trial experience in both state and federal court and has assisted in state court jury trials. Misty began her legal career with a firm representing heavy equipment suppliers in the construction industry in a wide variety of civil litigation and bankruptcy matters. 

REPRESENTATIVE EXPERIENCE

  • Defense of creditors, including defense against fraudulent transfer and preferential payment claims brought in bankruptcy adversary proceedings. 
  • Represented a neurosurgical medical practice in bankruptcy adversary proceeding arising from embezzlement committed against the client by an employee. 
  • Represented client in litigation involving partnership dispute of an oil and gas supply business. Obtained a favorable settlement that allowed both partners to dissolve the business and address the partnership's assets and liabilities in an equitable manner. 
  • Represented a trust beneficiary on a complex breach of fiduciary duty litigation against a large national financial institution. Obtained a seven-figure settlement for the client. 
  • Defended landman in litigation involving alleged conversion of oil and gas lease interests. 
  • Represented an oncologist in litigation involving a complex partnership dispute that affected several affiliated companies, many shared assets, and a multi-million dollar, twenty-five physician medical practice. 
  • Defended retailer in litigation brought pursuant to the Texas Deceptive Trade Practices Act. 
  • Represented liquidating trustee in 65+ bankruptcy adversary proceeding including preference actions, collection of debtor's accounts receivable and administration of proofs of claim.
