
Rick Flake is one of two instructors presenting a full day seminar entitled "Construction Contract Management," on Thursday, January 26, 2012. Pat Wielinski will co-chair "Insurance in the Construction Industry," a continuing education seminar for Texas lawyers, insurance professionals and contractors/engineers. Liz Debaillon and Rick Flake recently were guest lecturers in Professor Boong Yeol Ryoo's construction scheduling class at Texas A&M University. Topics discussed included the use of different types of scheduling methods, particularly Critical Path Method scheduling, in identifying and costing job delays for potential change orders and claims. Texas A&M offers both undergraduate and graduate degrees in construction science. Lawyers from CB&Y have been guest lecturers in the department of construction science for several years and look to continue that relationship.

Patrick Garner recently conducted a lecture on Employment and Labor law to construction management majors at the University of Houston. Topics covered were wage issues, discrimination claims, Americans with Disabilities Act issues, Osha requirements and jobsite safety, union related matters, and non-compete agreements. Patrick's practice at CB&Y includes cases and disputes involving both construction law and employment related issues. The University of Houston offers both undergraduate and graduate degrees in construction management, in the Department of Technology.

Pat Wielinski will be making a presentation on January 5, 2012 to the Construction Law Section of the Dallas Bar Association on the topic of the enactment of Chapter 151 of the Texas Insurance Code, the anti-indemnity statute. He will also cover the addition of Chapter 1811 to the Texas Insurance Code regulating certificates of insurance, particularly in the construction industry.

Marc Young and Stephanie O'Rourke, Principals in the San Antonio Office of Cokinos, Bosien & Young, authored and delivered presentations at the Padgett, Stratemann & Co. 2011 Annual Construction Industry Conference held on November 1, 2011, in San Antonio. John L. Grayson and Matthew D. Penny delivered a presentation on EPC Contracts to the International Energy Law, Contracts and Negotiations seminar recently held in Houston. Matt and John discussed factors and issues to be considered in drafting and litigating EPC contacts in the energy and international energy context. The seminar was presented by the Rocky Mountain Mineral Law Foundation and was sponsored by the Association of International Petroleum Negotiators and the Institute for Energy Law of The Center for American and International Law.

In June 2011, Chapter 151 of the Texas Insurance Code was signed into law, adding anti-indemnity provisions that apply to the Texas construction industry. Pat Wielinski has been conducting presentations and webinars to construction groups throughout Texas addressing the effect of the new statute. He and René Pinson have authored a white paper describing these important changes in the law and what they mean for the construction industry.
