Wielinski Brief Quoted by GA Court of Appeals
11/13/2009 - Transportation Ins. Co. v. Piedmont Constr. Group

The Georgia Court of Appeals decided Transportation Ins. Company v. Piedmont Construction Group, on November 13. Pat Wielinski of CB&Y filed an amicus curiae brief on behalf of the AGC of America, through its Risk Management Committee, and the local chapter of the Georgia AGC.   In that case, a subcontractor performing plumbing operations started a fire that destroyed an entire dormitory that was under renovation. The insurance company argued that the entire dormitory was excluded, but the court held that per the language of the policy, only the "particular part" upon which the subcontractor was welding (the single dormitory room in the Court's eye) was excluded. In its decision, the Court quoted from CB&Y's brief, and also used the brief's reasoning in another coverage case, decided on the same date.
